O texto discute as pr\u00e1ticas judiciais brasileiras e as teorias da argumenta\u00e7\u00e3o que as sustentam, demonstrando a manuten\u00e7\u00e3o de um padr\u00e3o autorit\u00e1rio no Judici\u00e1rio brasileiro que se relaciona estruturalmente \u00e0 jurisprud\u00eancia nazista dos anos 30 e 40 na Alemanha. Segue abaixo o resumo do artigo e seu endere\u00e7o eletr\u00f4nico:<\/span><\/div>\n<div style=\"font-size: 12pt; font-family: Calibri, Helvetica, sans-serif; color: #000000;\"><\/div>\n<div style=\"font-size: 12pt; font-family: Calibri, Helvetica, sans-serif; color: #000000;\"><span style=\"font-size: 12pt; font-family: Arial, Helvetica, sans-serif; font-weight: 300; display: inline !important; background-color: #f8f8f8;\">This article proposes a reflection on the persistence of Nazi jurisdictional models in contemporary legal theory, briefly comparing the work of authors such as Wolf, Larenz, Schmitt, Dworkin and Alexy. It aims to demonstrate the authoritarian and radically undemocratic character of certain theoretical constructions used in adjudication, particularly in Brazil.
