O PROCEDIMENTO LICITATÓRIO: TRATAMENTO DIGNO PARA AS OBRIGAÇÕES TRABALHISTAS

Resumo

A partir do pensamento tópico, busca-se demonstrar a obrigatoriedade da Administração Pública no procedimento licitatório estabelecido pela Constituição de 1988 e pela Lei 8.666/93 garantir o cumprimento das normas trabalhistas. O fundamento é a necessidade de efetividade dos direitos fundamentais constitucionais, além da própria função do Estado como um dos tutores das normas trabalhistas cogentes, vez que de ordem pública e de cunho social. Os instrumentos metodológicos utilizados são qualitativos, com enfoque na doutrina e jurisprudência. As fórmulas possíveis para proteção ao trabalhador no procedimento licitatório são analisadas no texto com base na vertente jurídico-dogmática. Tal opção visa dar prioridade aos elementos internos ao ordenamento jurídico e especial compreensão das relações no campo analisado e na realidade social em que se inserem.

ABSTRACT 

From the topical way of thinking the article seeks to demonstrate the obligation of Public Administration to protect labor rights in the bidding process established by the 1988 Constitution and Law 8.666/93. The reason is the need to give effectiveness to fundamental rights and the fact that the State is one of the guardians of labor standards because of its public and social nature. The methodological tools used are qualitative, focusing on the doctrine and jurisprudence. The possible formulas for worker protection in the bidding process are discussed in the text based on the juridical-dogmatic thinking, giving priority to internal elements to understand the legal system of relations in the social reality in which they operate.
