ETIMOLOGIA E CONCEITO HISTÓRICO DA PALAVRA "VARA"

RESUMO

Com autoridade de professor de Direito e de magistrado, o autor aborda a difícil questão da lingaugem jurídica, tomando por referencial a palavra "vara".

Penetra o tema em profunidade, embora o tornando de fácil compreensão, pela meneira clara e simples da exposição.

Assim, inicia pelo tratamento filosófico do conceito de "linguagem". Do valor da linguagem como base da ciência, desvenda os elementos da Lingüística para chegar ao campo da Etimologia, onde se situa o vacábulo "vara".

A partir deste objetivo predeterminado, põe em relevo o seu sentido jurídico. Neste terreno, segue todo o seu percurso histórico, a começar pela justiça no Brasil-Colônia e Brasil-Reino. Estuda as diversas modaliade de instâncias e a função dos juízes, analisando o tema com destaque pra as Ordenações Filipinas em cada período destacando o sentido assumido por essa palavra.

Salienta o eventual pitoresco como o dos detalhes do alvará de 1632 quanto ao modo de ser usado pelos juízes.

Passo, então, à metonímia, ou a extensão do significado dado à palvra "vara" ajustando o sentido correnet e costumeiro ao seu conteúdo científico e seu significado concreto. Nesta linha raevela a evolução do seu emprego no quotidiano brasileiro, tanto na linguagem constitucional, quanto na ingraconstitucional.

ABSTRACT

With the authority of professor of Law and magistrate, the author aproaches the dificult question of the legal language, talking for study the word "vara".

He studies the  subject deeply; even so it is easy to understand due to the clear and simple way of the exposition.

Thus, it initiates with the philosophical treatmente of the language concept. From the value of cience, then unmasks the lements of the Linguistics to get in the field of the etymology, where the word "vara" is placed.

From this predetermined objective, it puts in relief its legal directio. In this field, it follows all ites historical passage, beginning with the justice in the Brazil-Colony and Brasil-Reino. It sudies he diverse modalities of instances and the function of the judges, analyzing the subject with prominence for the Philippians Ordinances, in each period detaching the direction assumd for this word.

It goes, then, to the motonymy, or the extension of the meaning given to the word "vara" adjusting to the currente and usual meaning to its scientific contente and real meaning. In this line it discloses the evolution of its use in the ?Brazilian, quotidian, in the constitutional, and in the ingra-constitutional language.
