BREVES REFLEXÕES SOBRE O ENSINO DAS DISCIPLINAS JURÍDICAS TEORÉTICAS

Resumo

O presente artigo aborda a tensão recorrente no ensino jurídico de disciplinas teoréticas em face do caráter aplicado da ciência do Direito. Neste particular, faz-se necessária uma crítica ao modelo metodológico do Direito que exclua as interações com o mundo da vida. A vivência em sala de aula não se processa apartada da dimensão ética, cada vez mais redimensionada em vários tipos de discursos jurídicos, em especial no discurso da lei. Os avanços na Lingüística, na Tecnologia e Ciência da Informação apontam novas perspectivas de análise do fenômeno jurídico: de um lado, apontam modelos e de outro produzem um repensar no papel do professor, na era da informação.

ABSTRACT

The present essay deals with the recurrent tension in the juridical education of theoretical disciplines faced to the practical character of the Law Science. Regarding to this, the author criticizes the methodological model of Law that excludes its interactions with the life world. The teaching inside the classrooms cannot be separated of an ethical dimension, more resized, each time, in various types of juridical discourses, especially in the law discourse. The evolution in the language and in the technology and in the information science points to new analyses perspectives of the juridical phenomenon: By one side indicates models and by the other produces a rethink of the teacher’s role in the information era.
