O DIREITO EM MOVIMENTO: A LINGUAGEM DA REALIDADE E AS FALHAS DA COMUNICAÇÃO

Resumo

“Eu-não-sabia” não é uma resposta valida quando alguém é confrontado com a alegação de que não fez aquilo que era estabelecido por um comando geral. No movimento do Direito, o conhecimento é presumido em todas os campos relevantes e nas suas conseqüências em relação ajuízes, advogados e às pessoas como um contingente universal. Não obstante, não é possível dizer que a extensão das várias esferas de entendimento são homogêneas.
Essa situação revela um importante componente da cena na qual o Direito age, na sua dinâmica, e tem significativos efeitos na comunicação da realidade, especialmente desde o momento em que os instrumentos de mídia (televisão, jornais, internet, etc.) estão procurando descrições rápidas e incisivas dos eventos do mundo da vida e do fato de que, atualmente, esses são as maiores fontes de informação de todos os tipos. Conseqüentemente, é essencial analisar as várias aberturas que aparecem nos movimentos do Direito e a integração com as grandes aberturas da sociedade, porque elas possuem um papel muito importante quando se trata de responder a questões sobre como ele (o Direito) pode ser conhecido. 

ABSTRACT

l-did-not-know is not a valid response when someone is confronted with the allegation of not having done what is established by the law as a general command. In the movements of law, the knowledge is presumed on all relevant subject matter and consequences in its relation to judges, lawyers and the people as a universal contingent.  Nevertheless it is not possible to say that the extension of this various spheres of understanding is homogeneous. This situation reveals an important component of the scene in which the law acts in its dynamics and has significant effects on the communication of its reality, specially since the media instruments (television, newspapers, internet etc) are seeking for very quick and incisive descriptions of the events in the world of life and since they are, nowadays, the most visible bridge for information of all sort. Therefore it is essential to analyze the various communication gaps that appear in the movements of the law and in the integration with the wide borders of reality because they play a very important role when what matters is to answer the question on how it can be known.
