RESUMO

O presente artigo trata da relação médicopaciente, que evoluiu com o passar dos anos e deixou para trás a ideia de que médico era a única pessoa capaz de decidir sobre a saúde do paciente. O temor reverencial médico foi suplantado pela liberdade de autodeterminar-se, possibilitando ao paciente o exercício de seus direitos fundamentais. Objetiva-se demonstrar a importância do dever de informação do médico no que tange a obtenção do consentimento livre e
esclarecido do paciente, de maneira a legitimar a atuação médica e as exigências para que este consentimento seja válido na esfera jurídica. Analisa-se, por fim, a responsabilidade civil do profissional da área da saúde ao descumprir o
dever de informação, acarretando prejuízo para o paciente, de modo a indenizá-lo e, também, as excludentes de tal responsabilização.

ABSTRACT

This paper treats about the relationship between physician and patient, which have been developing along the years, leaving behind the idea that the physician was the only person capable to decide about patient’s health. This  reverential fear was replaced by the liberty of self-determination, which enable patient to act accordant to their fundamental rights. It aims to demonstrate the importance of the physician’s duty to inform in relation to the free and informed acceptance and consent of the patient, considering the legitimation of the medical act and juridical implications. For this reason, it analyses the liability of the professional that do not comply with the duty to inform, injuring the patient, having to indemnify them, and also exceptions of that response.
