Resumo

RESUMO

O objetivo deste trabalho é discutir o papel do processo na realização dos fins do Estado Constitucional contemporâneo. Para tanto, será traçado um breve histórico sobre a evolução do Estado, procurando-se pontuar as influências dos valores culturais reinantes em cada época sobre o sistema jurídico. Será abordada, também, a íntima conexão entre o processo e a proteção dos direitos e garantias fundamentais assegurados na Constituição, dentre os quais está o direito fundamental à tutela jurisdicional efetiva. As fases metodológicas e os modelos de processo civil serão analisados no intuito de avaliar qual dessas fases ou modelos são capazes garantir a oferta da tutela jurisdicional justa, tempestiva e efetiva, como resultado da construção democrática do direito no caso concreto, mediante a participação dialógica dos sujeitos processuais.

ABSTRACT

 The purpose of this paper is to discuss the role of the process in achieving the goals of the contemporary Constitutional State. To this end, it will be outlined a brief history of the evolution of the State, intending to enhance the influences of cultural values prevailing in each period on the legal system. It will be also addressed the intimate connection between the proceeding and the protection of fundamental rights and guarantees provided in the Constitution, among which is the fundamental right to effective judicial protection. The methodological phases and models of civil proceeding will be analyzed in order to assess which of these phases or models are able to ensure the provision of judicial protection fair, in time and effective, as a result of the democratic construction of the right case by case, through the dialogical participation of procedural subjects.
