RESUMO
É grande a discussão sobre a existência de uma Teoria Geral do Direito. Muitos doutrinadores renomados debatem a questão sem encontrar um posicionamento majoritário sobre o tema. Frente aos questionamentos trazidos por alguns desses autores, buscamos neste trabalho tentar destacar os argumentos que entendemos serem mais relevantes para definir um posicionamento próprio sobre tão controversa matéria. Para tanto, alguns temas relevantes do direito serão estudados comparativamente em busca de esclarecimentos. Dentre eles, destacamos a secular divergência entre jusnaturalismo e juspositivismo, bem como a maneira que tal divergência se reflete no direito, demonstramos a aparente contradição entre a eleição da natureza do direito e dos conceitos jurídicos como fundamento para a teoria do direito, bem como comparamos os resultados provenientes dessas analisando se algum deles pode fundamentar a existência de uma Teoria Geral do Direito.

ABSTRACT
There is a great discussion about the existence of a general theory of law. Many renowned scholars debate the issue without finding a majority position on the topic.The questions brought by some of these authors, we try, in this paper, to highlight the arguments that we believe that are the most relevant to define my own position on such a controversial matter. To do it so, some relevant issues of law will be studied comparatively for additional information. Among them, we highlight the secular divergence between natural and positive law, and how this divergence reflects at law; the apparent contradiction between the election of the nature of law and legal concepts as a foundation for the theory of law; after that, we compare the results from these analyzing, and see if any of them can substantiate the existence of a general theory of law.
