RESUMO

 Neste artigo trata da problemática da relação entre autogoverno da magistratura e sistema democrático. Trata-se do papel dos conselhos judiciais nas democracias contemporâneas e, particularmente, do estatuto e dos papéis desempenhados pelo Conselho Superior da Magistratura italiana (CSM) no ordenamento jurídico e político da Itália. Para tanto é feita uma reconstrução do surgimento e da evolução do CSM, sendo então apresentadas suas principais características institucionais. Em seguida são apresentadas algumas das deficiências da atuação do CSM no campo da avaliação profissional e poder disciplinar e suas relações com as disfunções do ordenamento judiciário italiano.

ABSTRACT

 This paper deals with the problem of the relationship between the self-government of judiciary and democratic system. The role of judicial councils in contemporary democracies, and particularly the status and the roles played by the Superior Council of the Italian Magistracy (CSM) in the legal and political system of Italy is object of analysis. For such a reconstruction of the emergence and evolution of the CSM is taken, and then presented their main institutional characteristics. Then we present some of the weaknesses of the performance of CSM in the field of professional evaluation and disciplinary power and its relations with the dysfunctions of the Italian judicial system.
