RESUMO

 Partindo do problema que o filho maior não tem, no ordenamento jurídico pátrio, a possibilidade de desconstituir uma paternidade não exercida, a qual lhe gera deveres futuros, o presente artigo objetiva demonstrar que a socioafetividade, fundamentada no princípio da solidariedade, é indispensável para a constituição da relação paterno-filial. Com base no critério de reciprocidade das relações de pai e filho, o estudo conclui que, quando um pai não cumpre os deveres inerentes à função paternal perderá, consequentemente, os direitos decorrentes da mesma função, o que possibilita, caso seja a vontade do filho, a desconstituição formal da paternidade.

ABSTRACT:  Starting from the problem that the son who has reached adulthood does not have in the national laws the possibility of deconstitute paternity not exercised, which will generate future duties, this paper seeks to demonstrate that socioaffective, based on the principle of solidarity, is indispensable to establish a paternal bond. Based on the criterion of reciprocity relations of father and son, the study found that when a parent does not fulfill its paternal function, consequently lose the rights arising from the same function, which allows, if it´s the will of the child, the formal deconstitution of paternity.
