RESUMO:

 Este ensaio tem por escopo apresentar algumas notas sobre o princípio da reserva do possível orçamentário, na perspectiva da implementação de políticas públicas. Procura-se identificar o problema relacionado à judicialização dessas políticas a partir das teorias da reserva do possível orçamentário e do mínimo existencial, investigando as tendências dos Tribunais pátrios no tratamento da matéria, sobretudo dos Tribunais Superiores.

ABSTRACT

 The scope of this essay is to present some notes on the principle of proviso of the possible in view of the implementation of public policies. It seeks to identify the problem with the judicial review of these policies from the theories of proviso of the possible and existential minimum, investigating trends of national Courts in the treatment of matter, especially of the Superior Courts.
