RESUMO
Considerando a função social integradora que o direito exerce, a mesma não pode ser realizada tão-somente pelo entendimento inerente ao mundo da vida, tampouco pelos sistemas funcionais reguladores, sobretudo os sistemas econômico e político especializados na racionalidade estratégica. Habermas vê, na figura do direito positivo moderno, a possibilidade de assimilar - via ação comunicativa - a tensão entre facticidade e validade. À vista de tal possibilidade, o filósofo busca envolver-se com o problema central que abarca as possibilidades de reprodução social, à luz das pretensões de validade. A integração social, fenômeno que se articular sobre a tensão existente entre o factual e o contrafactual, direciona-nos à implementação do conceito mundo da vida com vistas a implementação de um direito legitimo que assegura e garante o reconhecimento dos sujeitos entendendo-o como predicado da sua dignidade. O emprego da expressão “colonização” se deve ao fato de que questões antes abertas a uma proposta de solução comunicativa a ser travada no mundo da vida são transportadas para uma discussão jurídica que, além de “abafar” tal produção genuína de soluções pelos próprios afetados, reflete a estrutura do direito não referida ao próprio mundo da vida, mas sim aos subsistemas do mundo da vida (economia e administração) acoplados as estruturas do sistema da biopolítica.

ABSTRACT
Considering the integrative social function that the law exercises, the same cannot be accomplished merely by the inherent comprehension to the world of life neither by the regulator functional systems, mainly the economical and political ones specialized in the strategic rationality. Habermas sees in the figure of the modern positive law, the ability to assimilate – through communicative action - the tension among facticity and validity. In the view of such possibility, the philosopher seeks to engage the central problem that embraces the possibilities of social reproduction, in the light of validity claims. The social integration, a phenomenon that articulates itself about the existing tension among the factual and the counterfactual, directs us to implement the concept of life world with a view to implementing a legitimate law which ensures and guarantees the recognition of the subjects understanding it as a predicate of its dignity. The use of the term "colonization" is due to the fact that issues before opened to a proposal of communicative solution to be fought in the world of life are transported to a legal argument that besides "drowning out" such genuine production of solutions by the affected oneselves reflects the structure of the law not referred to that world of life itself, but to the subsystems of the living world (economy and management) coupled the structures of the biopolitics system.
