Resumo

O trabalho estuda o caso “Obrigações referentes a Negociações para a Cessação da Corrida por Armas Nucleares e para o Desarmamento Nuclear”, julgado pela Corte Internacional de Justiça em 2016. Muito embora não tenha prosseguido para a fase de decisão de mérito, ele é significativo por estabelecer uma nova exigência para a admissão de um caso para julgamento. O presente artigo critica o acórdão a partir de sua coerência interna, do direito positivo aplicável à determinação da jurisdição da CIJ e dos precedentes relevantes. Conclui-se que a Corte afastou-se de sua jurisprudência sobre a identificação de uma disputa ao proferir uma decisão que não prestigia o acesso à justiça.
