Resumo

O artigo trata basicamente das relações entre a tipicidade e a ilicitude penal, acabando por colocar a segunda no primeiro “degrau valorativo” da análise da conduta punível, a partir de uma visão essencialmente axiológica do tipo.

Tinha-se em vista solucionar a questão do erro sobre os pressupostos objetivos de uma causa de exclusão da ilicitude, que o então art. 59, I, do CP alemão de 1871, não resolvia diretamente.

O ponto de partida foi a consideração de que o tipo penal contém uma parte positiva e outra, negativa. A primeira, formada pela descrição da conduta incriminada; a segunda, negativa, pela ausência de causa de exclusão da ilicitude ou elemento normativo do tipo.

Desse modo, a presença de uma justificativa ou de um elemento normativo, funcionando como elemento negativo, impede a realização desse tipo “total”, composto das partes positiva e negativa, e abrangente de todos os elementos que fundamentam, delimitam e excluem a ilicitude.

ABSTRACT

The article deals primarily with the relationships between typicity and criminal unlawfulness, ending by putting the second in the first “evaluative step” of the analysis of criminal behavior, from a vision essentially axiological of the penal type.

People had in mind to solve the issue of error in objective assumptions of a cause of unlawfulness exclusion that the former article 59, I, of the German Penal Code of 1871, did not solve directly.

The starting point was the consideration that the penal type contains one positive and another negative part. The first, formed by the description of the prosecuted condut and the second, negative, by the absence of the unlawfulness exclusion or normative element of the penal type.

In this way, the presence of a justification or a normative element, working as negative element, prevents the achievement of such “total” penal type, composed of positive and negative parts, and inclusive of all elements that establish, limit and exclude the unlawfulness.
