Resumo

O presente artigo propõe uma abordagem da Filosofia do Direito para o problema da representação nas democracias contemporâneas. Para tanto, partindo-se da dicotomia liberdade positiva dos antigos/liberdade negativa dos modernos, é demonstrada a conexão entre a liberdade na Grécia antiga e a democracia direta ateniense, assim como entre a liberdade do mundo moderno, o princípio representativo e o regime democrático. A partir dessa análise, vislumbrou-se uma possível correlação entre a liberdade contemporânea e a democracia representativa e participativa como forma possível e desejável de exercício do poder na atualidade. Por fim, demonstrou-se que a exacerbação da liberdade individual no mundo contemporâneo, que conduz à apatia política, é um risco à própria liberdade e à democracia, de maneira que é imprescindível a conciliação entre a liberdade individual e a participação política.

This paper proposes an approach regarding the philosophy of law to the problem of representation in contemporary democracies.Therefore, starting from the dichotomy of ancient positive liberty and the modern negative liberty, the connection between freedom in ancient Greece and Athenian direct democracy is shown, as well as between the freedom of the modern world, the principle of representation and the democratic regime.From this analysis, we catch a glimpse of a possible correlation between contemporary freedom and representative and participatory democracy, as viable and desirable way of exercising power today. In conclusion, it shows that the exacerbation of individual freedom in the contemporary world, which leads to political apathy, is a risk to freedom itself and to democracy, so that it is indispensable to reconcile individual freedom and political participation.
