A força vinculante como atributo da lei não é um efeito caracterizado pelo automatismo. Ela se insere num âmbito de historicidade e o seu conhecimento exige a metodologia que escapa da análise meramente conceitual da lei.

The binding effect, as an attribute of law, is not characterized by the authomatism. It is part of a historical process and its knowledge deals with a methodology that is beyond the merely conceptual analyses of the law.
