RESTRIÇÕES AO USO DE SÍMBOLOS RELIGIOSOS: UMA DISCUSSÃO A PARTIR DA JURISPRUDÊNCIA EUROPEIA E CANADENSE - DOI: 10.12818/P.0304-2340.2013vJJp49

Resumo

O presente artigo discute a instituição de limitações à exibição de símbolos religiosos. Realizar-se-á uma análise comparativa de jurisprudência da Corte Europeia de Direitos Humanos, do Conselho Constitucional da França e do Supremo Tribunal do Canadá. Diante da constatação de posicionamentos divergentes por parte desses tribunais, no que tange aos parâmetros de análise da legitimidade de restrições à liberdade de manifestação religiosa, propõe-se a adoção de uma interpretação restritiva das limitações permitidas à liberdade de manifestação religiosa, com base em distintos instrumentos de salvaguarda dos direitos humanos.

ABSTRACT

 The present article discusses the imposition of  measures limiting  the exhibition of religious symbols. It analyzes and compares judicial decisions of the European Court of Human Rights, the Constitutional Council of France and the Supreme Tribunal of Canada. Noting the divergent positions assumed by each of these tribunals in what concerns the parameters of analysis of the legitimacy of restrictions on the freedom of religious manifestation, the article proposes the adoption of a restrictive interpretation of permissible limitations on the freedom of religious manifestation. Such proposition is based on the interpretation of distinct instruments for the protection of human rights.
