Resumo

O presente artigo está situado no âmbito da Filosofia do Direito, da Filosofia Política, da História do Direito e pretende abordar as manifestações populares egípcias do século XXI à luz do direito de resistência na luta por direitos fundamentais – civis e políticos – no enfrentamento direto dos indivíduos em face do poder ditatorial do então presidente Hosni Mubarak. Para tanto, analisa-se a evolução histórica e teórica do direito de resistência e da desobediência civil, apresentando-se normas de ordens jurídicas estrangeiras que fundamentam as ideias desenvolvidas neste trabalho, as quais se baseiam nas formulações teóricas de Thomas Hobbes, Santo Tomás de Aquino, Hannah Arendt, Gene Sharp, Norberto Bobbio, Giorgio Agamben, entre outros autores. Por fim, discute-se as características próprias do instituto e sua prática e aplicação pelos egípcios no exercício do direito de resistência face ao Estado usando as formulações libertárias da desobediência civil no contexto das revoltas populares árabes.

ABSTRACT

This paper is situated within the scope of Philosophy of Law, Political Philosophy, History of Law and intends to address the popular demonstrations in Egypt on the XXI century, in the light of the right of resistance in the struggle for human, civil and political rights, in the direct confrontation of individuals against of the then president Hosni Mubarak. To this end, we analyze the historical and theorical evolution of the right of resistance and civil disobedience, presenting norms of foreign legal orders that support the ideas developed in this work, which are based on theorical formulations of Thomas Hobbes, Saint Thomas Aquinas, Hannah Arendt, Gene Sharp, Norberto Bobbio, Giorgio Agamben, among others. Finally, we discuss the characteristics of the institute and its practical application by the Egyptians in the exercise of the right of resistance against the State using libertarian formulations of civil disobedience in the context of arab riots.
