Abstract

O presente trabalho reconstrói o histórico de formação da garantia do devido processo
processual legal a partir dos precedentes da Suprema Corte dos Estados Unidos. Além de
lançar luz sobre o período histórico de formação da garantia, que se transformaria no centro
de gravidade do processo civil contemporâneo, com elevada influência sobre a doutrina brasileira, pretende-se esclarecer que, apesar de sua importância, a garantia é vista, atualmente, como instrumental à proteção dos direitos materiais, devendo ser ponderada com outros valores relevantes que incidam sobre o caso.
